This page contains the Terms and Conditions (T's & C's) which relate to your rights and obligations when using this website (www.canvaswash.com) and any goods or services you purchase via the site. Any other rights that you may have granted by law remain unaffected by these T's & C's. We reserve the right to ammend these T's & C's at any time without prior notice, all changes will be posted on this page and will be effective immediately. By continuing to use the site you are bound by these T's & C's.
All contracts entered into with Canvas Wash will be subject to these T's & C's. All terms and conditions appearing or referred to in the purchase order or otherwise stipulated by the Client shall have no effect, unless such purchase order is in our standard form of order. Any variation to the contract must be confirmed in writing by us.
This section sets out the data processing practices carried out through the use of the Internet and the World Wide Web by Canvas Wash. The collection, processing and usage of personal data shall only be undertaken with the consent of the individual or due to a legal obligation. Should anonymous or pseudonymous data be needed for business purposes, then only these forms of data shall be used. If you have any requests concerning your personal information or any queries with regard to these practices please contact us at info@canvaswash.com.
We collect personal information from visitors to this web site through the use of online registration forms and every time you e-mail us your details. We also collect information about the transactions you undertake. However, your financial details (payment card numbers etc) are not stored by us. We collect additional information about your visit to our web site automatically.
The information we collect is used for processing any orders you place and providing you with information about the products and services that we offer.
Our web site may contain links to other web sites which are outside our control and are not covered by this Privacy Policy. You are not permitted to reuse any parts of it or to distribute any content for any purpose other than personal viewing and the printing of individual pages. We reserve the right to restrict, terminate and suspend anyone from using this site.
The site design and the goods sold through the site are subject to alteration, and we reserve the right to make these changes and improvements without prior notice. We will make you aware of any changes to the goods advertised before we dispatch them.
By filling in and sending off the order form on the Internet, you are making a binding offer for the conclusion of a contract of purchase and/or a contract for work and materials. Before finally sending off the order form, you will have the opportunity to check that your details are right and if necessary to correct them. Once you have submitted your order you will be sent an order confirmation via e-mail. The order confirmation does not represent an acceptance of the offer but acknowledges that we have received your order. The contract only materialises when we confirm the dispatch to you with a second e-mail (“Shipping Confirmation”). We reserve the right to reject your order at any time up to this point.
The specifications, sizes, images, descriptive content and advertising published by us or contained on our site are issued only for giving an approximate idea of the goods described in them and colours shown are intended as a guide only. They do not form part of the T's & C's. Actual colours may differ due to your own monitor settings, over which we have no control.
A quotation shall not be binding on Canvas Wash and a contract will only come into being upon acceptance by us of the purchase order by signing or counter signing the date of the purchase order and returning it to a customer.
Quotations submitted by Canvas Wash shall remain open for acceptance by the Client for a period of 28 (twenty eight) days from the date of the quotation (unless a different period is specified in the quotation) or when we withdraw the quotation.
The Client unconditionally guarantees that any element of text, graphics or other artwork furnished to Canvas Wash for inclusion in the design project are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect and defend Canvas Wash and it’s subcontractors from any claim or suit arising from the use of such elements furnished by the Client.
All creation files remain the intellectual property of Canvas Wash on completion of a design project.
Canvas Wash shall be free to reproduce, use, disclose, display, exhibit, transmit, perform, create derivatives works, and distribute any item from the Clients Design Work unless specifically agreed to do otherwise. Further, Canvas Wash shall be free to use any ideas, concepts, know how or techniques acquired during the design project for any purpose whatsoever including but not limited to developing, manufacturing and marketing products and any other items incorporating such information unless specifically agreed otherwise.
All prices for goods are subject to change without notification, and all such changes are effective immediately on publication of the site.
Full details of prices for all goods are given in each product section of our Website. You are responsible for payment of all taxes and duties in your local jurisdiction.
If you make payment in a currency which is different to the currency of your Bank or credit card statements, then please note the price quoted may differ slightly from that charged to you due to currency fluctuations.
Any offers or promotions are run at our discretion and are valid until the date shown or until we decide to cancel them. We reserve the right to amend or cancel any offers or promotions at any time.
Where services are sold by reference to our published price list or tariff structure, the price payable for those services shall be the ruling price as published in the price list or tariff structure current at the date of purchase.
Services
Unless otherwise agreed in writing by us, invoices shall be payable by the Client immediately upon completion of the relevant service to which the invoice relates. The Client shall make all payments due to us by cheque (supported by an appropriate cheque guarantee card) or by bankers draft or in cash or by telegraphic or electronic transfer direct to the company bank account or by arranged Direct Debit (and in each case in pounds sterling). If the Client fails to pay any amount due to us under this Agreement on the relevant due date, default interest at the rate specified by the Late Payment of Commercial Debts (Interest) Act 1998 shall be added to such amount for the period from the day after the due date until the date of receipt (whether before or after judgment) together with any reasonable and proper amounts incurred by Canvas Wash in seeking to recover such late payment from the Buyer (including, without limitation, legal fees).
Print Work
All print work will be invoiced for prior to the designs being sent for print. No work will go to print until the funds have been received and have cleared in our bank acount.
It is our aim to dispatch all orders received before 1pm on Mondays to Thursdays within 48 hours of receiving the order. We reserve the right to withdraw this offer at anytime or change it in anyway we require without prior notice.
Any changes take effect immediately on publication to this site.
Friday, Saturday, Sunday and Bank Holidays are not included as working days.
Exact delivery dates and times are not provided. Deliveries are dispatched using a 3rd party courier.
Our supplier currently use Parcel Force and City Link as our courier and reserve the right to change this without prior notice.
Delivery dates and times are for the mainland UK. Offshore deliveries are subject to long shipping times.
We cannot be held responsible for the actions of our suppliers couriers and any delays that are incurred due to their actions.
You have the right to cancel the Order up to the point at which the goods are dispatched by us. Should you cancel your order before dispatch We will refund in full the amount forwarded by you within 21 days of the order being cancelled. Credit card charges will be refunded on the same credit card only. Our acceptance of an order does not take place until dispatch of the order, at which point a purchase contract will be made.
You may also cancel Your Order at any time up to the end of the seventh (7th) working day starting from the date immediately after you receive the ordered goods provided those goods are unused and in no worse condition that when they were received by you. To cancel your order you must notify us in writing before the end of the period set out above. All cancellations should be undertaken in accordance with and subject to Our Returns and Exchanges Procedure.
Once You have notified us that you are cancelling your order, any sum debited to us from your credit card will be re-credited to your account as soon as possible and, in the event that the Goods have been dispatched, within 21 days of your cancellation notice PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you and with their original packaging. If applicable, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
Our Website is provided without any warranties or guarantees. You must bear the risks associated with the use of the Internet. The services provided by this Website are provided on an “as is” and “as available” basis. We are not responsible to you if we are unable to provide the Website or any Products for any reason beyond our control.
We acknowledge and agree that we shall perform our Services with reasonable skill and care and in accordance with good industry practice.
Our Website may provide content from other Internet sites or resources and while we try to ensure that material included on our Website is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. We will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with our Website. If we are informed of any inaccuracies in the material on the Website we will attempt to correct the inaccuracies as soon as we reasonably can.
Your exclusive remedy in respect of any claim for breach of contract, negligence or otherwise, in relation to the Products or Services shall be limited to replacement of the relevant Product, reperformance of the relevant Service or a refund of the amount you have paid to Canvas Wash for either.
We will not be liable for any failure in the performance of any of our obligations under the agreement caused by factors outside our control.
Your statutory rights are not affected.
The Client acknowledges and agrees that Canvas Wash shall produce the Design Work based on information provided to it by the Client.
It shall be the responsibility of the Client (and not us) to review and approve the content of all design (including, without limitation, the spelling of names and addresses and the accuracy of telephone numbers) at the time of the completion of such Design Work by us to the Client for approval by the Client.
We have no liability to the Client for any inaccuracies in the Design Work if and to the extent that the Client has failed to review and/or approve (or require amendment (as the case may be)) provided to the Client by us pursuant to this Agreement.
The Client shall indemnify Canvas Wash and keep us indemnified from and against any and all actions, costs (including, without limitation, the cost of defending any legal proceedings), claims, proceedings, accounts and damages in respect of any infringement or alleged infringement by a third party of any patent, registered design, unregistered design, design right, copyright, trade mark or other industrial or intellectual property rights resulting from compliance by us with the Client's instructions, whether expressed or implied.
All copyright and intellectual property rights existing in our designs and products and in the content of the site are the property of us. Any designs where a third party has be credited with copyright will remain property of the third party with all rights reserved.
